  1. Municipal Approval: All building plans purchased from DIYHousePlans.co.za must be submitted to and approved by your local municipality. It is the purchaser’s responsibility to ensure that these plans meet all local municipal requirements and zoning regulations.
  2. National Building Regulations and SANS 10400 Compliance:
    • National Building Regulations: The plans are designed to comply with South Africa’s National Building Regulations (NBR). It is essential that any construction work adheres strictly to these regulations. Non-compliance may result in legal and financial repercussions.
    • New SANS 10400 Regulations: As of 1 July 2011, new building regulations under SANS 10400 have been implemented. These include requirements such as cavity walls for coastal areas, which are not included in our plans. Regulation 1(g) also mandates that a competent person periodically inspect the building work and issue a certificate upon project completion. Enforcement of this regulation may vary. The responsibility to ensure compliance with SANS 10400 and to appoint a SACAP-registered professional for inspections and certification rests with the purchaser. DIYHousePlans.co.za can provide a list of professionals, but all related costs and responsibilities are to be managed by the purchaser.
  3. Appointment of Registered Professionals: After purchasing a building plan, you may need to appoint a SACAP-registered architect or architectural technologist to assist with modifications, submit plans for municipal approval, and oversee the construction process to ensure compliance with national standards.
  4. Limitations of Liability: Plans are provided “as is” without warranties or guarantees regarding their suitability for your project. DIYHousePlans.co.za is not liable for issues arising from the use of these plans, including construction defects or failure to obtain municipal approval.

 

Modifications and Customization: Any modifications to the plans should be performed by a qualified SACAP-registered professional. DIYHousePlans.co.za is not responsible for changes made to the original plans. The information contained on this website only serves as guidelines on the specific matters and is not intended to be comprehensive in the advice on offer. It is important to take note of all the information and advice on offer on the website. Unless the buyer has selected to appoint inhouseplans.com to complete the site plan for the specific stand, it is the responsibility of the home owner buying a plan on inhouseplans.com, to complete the site plan and drainage layout on the building plans, to submit and approve the plans at the local authority and to pay all fees applicable to the local authority, the NHBRC etc. All fees payable to the local authority, the NHBRC etc. are the responsibility of the home owner.

REFUND POLICY

  1. Non-Returnable Products: All plans are non-returnable and non-refundable after delivery due to their digital nature and proprietary value.
  2. Incorrect Delivery: If incorrect plans are delivered, you are entitled to a replacement at no additional cost. Contact our customer service within 7 days of delivery with proof of purchase and details of the incorrect plans.
  3. Before You Order: Review all plan details carefully to ensure they meet your needs. This includes size, dimensions, orientation, and other specifications.
  4. Consumer Protection Act Compliance: This policy complies with the South African Consumer Protection Act (CPA). Contact us with any concerns or queries before finalizing your order.

COPYRIGHT AND INTELLECTUAL PROPERTY

  1. Single Use License: You receive a non-transferable, non-exclusive license to use the purchased design for one single-family home only. Additional homes require separate licenses.
  2. Prohibited Actions: You may not copy, reproduce, distribute, or modify the designs in any manner.
  3. Multiple Dwellings: Using the design to build multiple homes requires additional plans purchased from DIYHousePlans.co.za. Unauthorized use may lead to legal action.
  4. Intellectual Property Rights: Designs and materials remain the intellectual property of DIYHousePlans.co.za. Purchase does not transfer intellectual property ownership.
  5. Legal Compliance: Comply with South African copyright laws and regulations. Unauthorized use may result in legal penalties.

TERMS FOR ORDERS OUTSIDE SOUTH AFRICA

  1. South African Building Regulations: Plans comply with South African NBR but may not meet regulations in other countries.
  2. International Compliance: DIYHousePlans.co.za does not guarantee compliance with regulations outside South Africa. It is the purchaser’s responsibility to ensure plans meet local requirements and obtain approval from local authorities.
  3. Local Authority Approval: Obtain approval from local authorities in your country. Compliance with local codes and regulations is your responsibility.
  4. No Warranty for International Use: We recommend consulting a local architect or building professional to ensure compliance with local regulations.
  5. Intellectual Property and Copyright: Plans are protected under South African and international copyright laws. Unauthorized use may result in legal action.
  6. Applicable Laws: Any legal disputes will be governed by South African law, and you consent to the jurisdiction of South African courts.
